At CB Air Conditioning and Maintenance (“CB Air Conditioning,” “we,” or “our”), we strive to provide high-quality workmanship and professional service when delivering HVAC installation, repair, and maintenance solutions at your property (“Customer”). Our services include air conditioning repair and replacement, HVAC system installation, maintenance and inspections, ductwork installation and repair, thermostat installation, and indoor air quality solutions for residential and commercial properties.

Promotions and Pricing Disclaimers

From time to time, CB Air Conditioning may offer promotional pricing or discounts. All promotions are subject to availability, may be modified or discontinued at any time, are not retroactive, and are not combinable unless expressly stated. Unless otherwise noted, promotions do not apply to commercial projects.

Estimates and Scope of Work

All estimates are based on conditions observed at the time of inspection and may change if site conditions differ. Pricing adjustments may occur due to:

System age and condition

Electrical limitations

Ductwork issues

Environmental factors

Any changes will be communicated prior to proceeding.

Equipment & System Conditions Disclaimer

HVAC systems are complex and performance can vary. CB Air Conditioning does not guarantee uniform temperature, airflow, or efficiency due to factors outside our control. Existing ductwork, insulation, and system age may affect results. Variations are not considered defects.

Environmental Conditions

CB Air Conditioning is not responsible for system failure caused by:

Moisture or water intrusion

Flooding or leaks

Improper drainage or ventilation

Extreme weather or environmental factors

Inspection or maintenance does not guarantee future performance under all conditions.

Residential & Commercial Use

System performance and durability depend on use, maintenance, and environment. No HVAC system is indestructible.

Furniture, Equipment, and Site Preparation

Customers are responsible for providing clear and safe access to HVAC equipment and removing furniture, appliances, and personal items unless otherwise agreed in writing. CB Air Conditioning may refuse to move items that are unsafe or oversized, and is not responsible for damage to items left in work areas.

Post-Service Instructions & Access Restrictions

Customers agree to follow all post-service or maintenance instructions. CB Air Conditioning is not responsible for damage caused by failure to follow these instructions or premature use of the system after service.

Force Majeure

CB Air Conditioning shall not be liable for delays or failure to perform caused by events beyond reasonable control, including severe weather, natural disasters, supply chain disruptions, labor shortages, governmental actions, or utility outages.

Hazardous Materials

If asbestos, mold, or other hazardous substances are suspected or discovered during service, work will be suspended. Customers are responsible for remediation by licensed professionals. CB Air Conditioning is not responsible for related costs or delays.

Warranty Limitations

Any warranty is limited to the scope and duration expressly stated in writing and does not cover damage caused by:

Improper maintenance

Abuse or neglect

Environmental factors

Structural issues

Third-party modifications

Limitation of Liability

To the fullest extent permitted by law, CB Air Conditioning’s liability shall not exceed the total amount paid for the services giving rise to the claim. CB Air Conditioning shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages.

Dispute Resolution

Any dispute shall be resolved through binding arbitration in the State of Hawai‘i. Each party shall bear its own costs unless otherwise required by law.

Modifications

CB Air Conditioning reserves the right to modify these disclaimers at any time. Updates are effective immediately upon posting or written communication.
