CB Air Conditioning and Maintenance (“Company,” “we,” “our,” or “us”) provides heating, ventilation, and air conditioning (“HVAC”) services throughout the State of Hawai‘i. These Terms of Use (“Terms”) apply to all services and communications with our Company, including phone calls, emails, website submissions, and SMS/text messaging through A2P-registered numbers.
By requesting information, scheduling service, submitting a form through our website, or communicating with us, you (“Client,” “you,” or “your”) agree to these Terms.
1. Services Provided
We provide residential and commercial HVAC services throughout the State of Hawai‘i, including but not limited to:
HVAC system installation
Air conditioning repair and replacement
HVAC maintenance and inspections
Ductwork installation and repair
Thermostat installation and configuration
Indoor air quality solutions
Emergency HVAC services
We do not conduct online product sales through our website.
2. Estimates, Scheduling & On-Site Conditions
Service estimates are based on visible conditions and information provided by the Client.
Additional work or charges may be required if previously undisclosed issues are discovered, including but not limited to:
Electrical issues
Structural limitations
Refrigerant leaks
Hidden damage or improper prior installations
Service scheduling may be adjusted due to weather conditions, equipment availability, site access, or safety considerations.
3. Payments & Deposits
A deposit may be required for certain services, equipment orders, or installation projects.
Payment terms will be provided in the service agreement or estimate. Unless otherwise agreed in writing:
Payment is due upon completion of service.
Equipment installations may require staged payments.
Failure to make payment may result in service delays or cancellation of future work.
4. Client Responsibilities
The Client agrees to:
Provide safe and unobstructed access to the HVAC system and work area
Ensure pets and personal items are secured or removed from work areas
Inform the Company of any known issues with electrical systems, ventilation, or prior HVAC repairs
Failure to provide proper access or accurate information may delay service or require rescheduling.
5. Equipment, System Conditions & Limitations
HVAC performance may vary based on several factors outside of the Company’s control, including:
Existing ductwork conditions
Insulation quality
Electrical capacity
System age and prior installation quality
Environmental conditions and humidity
While we strive for optimal performance, we cannot guarantee efficiency improvements or system lifespan beyond manufacturer specifications.
6. Warranty & Service Limitations
Any warranties provided apply only to the Company’s labor unless otherwise stated.
Equipment warranties are typically provided by the manufacturer and are subject to their terms and conditions.
Warranty coverage does not include damage caused by:
Improper use or lack of maintenance
Power surges or electrical issues
Natural disasters or environmental conditions
Unauthorized modifications or repairs
7. Cancellations, Rescheduling & Delays
Clients may reschedule or cancel appointments with reasonable notice.
Deposits may be forfeited if:
Equipment has already been ordered
Materials have been purchased
Cancellation occurs within 48 hours of the scheduled service
The Company is not responsible for delays caused by weather, supply chain issues, safety concerns, or circumstances beyond our control.
8. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for:
Pre-existing damage or system defects
Indirect or consequential damages
Loss of business, comfort, or income due to equipment failure
Our maximum liability is limited to the amount paid for the specific service performed.
9. Photography & Marketing
Unless otherwise requested in writing, the Company may photograph completed projects or equipment installations for internal documentation and marketing purposes.
Photos will not include personal identifiers without permission.
10. Governing Law
These Terms are governed by the laws of the State of Hawai‘i, without regard to conflict-of-law principles.
11. SMS Messaging Terms (A2P Compliance)
By providing your phone number through our website, forms, or service requests, you consent to receive SMS/text messages related to:
Appointment confirmations
Service reminders
Scheduling updates
Technician arrival notifications
Estimates and service information
Customer support communications
Message & data rates may apply. Message frequency varies.
Opt-Out Instructions
Reply STOP to cancel SMS messages.
Reply HELP for assistance.
We do not sell or share personal data. Messaging follows A2P, CTIA, and carrier compliance guidelines.
12. Carrier Liability
The Company is not responsible for message delivery failures, delays, or errors caused by mobile carriers.
Message delivery may be affected by network availability, carrier policies, or device settings.
We are not liable for damages resulting from undelivered or delayed messages.
13. Age Restrictions
By using our services or providing your phone number for communication, you confirm that you are at least 18 years old or have permission from a parent or legal guardian.
